Controller vs. Processor Roles

OmniNext Tech operates as both a data controller and a data processor, depending on the context.

Controller and Processor Status (EEA, UK, Brazil and Similar Jurisdictions)

OmniNext Tech LLC acts as a Data Controller for Personal Information collected directly from users of the Platform for account management, billing, AI logging, usage analytics, marketing, and business operations.

OmniNext Tech acts as a Data Processor when processing Personal Information on behalf of customers who use the Platform to manage their own customers' data pursuant to our Terms of Service and Data Processing Agreement.

If you are interacting with a business that uses our Platform, that business is the Data Controller of your information, and its privacy policy governs that processing.

5. Security of Personal Information

OmniNext Tech implements administrative, technical, and organizational measures designed to protect Personal Information against unauthorized access, alteration, disclosure, or destruction.

OmniNext Tech does not use your Personal Information to train generalized public AI models. AI subprocessors are contractually restricted to processing data solely to provide the requested AI service.

7.2 Determining Retention Periods

When determining appropriate retention periods, we consider:

  • The risk of harm from unauthorized disclosure;

  • Contractual requirements;
